However, too fierce competition might endanger the solvency of the institutions involved, and hence urge the supervisor to draw the firms’ attention to predatory pricing or unfair conduct. In most jurisdictions, financial firms are not subject to special competition rules: the common regime is applicable, administered by the general competition authorities, whether the national
or the European ones. It is therefore widely accepted that the prudential authorities should not be involved in reviewing the competition aspects of decisions made by financial firms. So e.g. are merger decisions often subject to the prudential supervisor’s authorisation, but only from the angle of sound and efficient banking , not from the angle of the competitive consequences.
